Editor's note: The editor has neither sought nor has received authority to edit this petition. The name of the organization, however, has been retranslated in the title of this posting (only). The following commentary has been neither read nor approved by the author of this petition. The original Hungarian version of this petition is accessible here.

Commentary:The foreign government in power in Hungary is feverishly working towards the creation of a "European Gaza" in Hungary and a new "Promised Land" for an alien people in the heart of Europe. It spares no effort to exterminate Hungarians to make room for the colonizing Israelis - a process already well underway. This petition was prepared by desperate Hungarians who have worked all their lives but have now lost their homes and meagre possessions to usurious banking practices, or are about to be put out on the street by force.

The petitioners have no home, nothing left to feed their families, and certainly no means to hire accredited translators or high-priced lawyers to prepare this petition in English and in conformity with expected formality. They hope the reader will take this handicap into consideration if this English version sounds awkward at times or deviates from accepted legal format. They have faith in the common decency of the good people of the English speaking world and in the their moral courage to judge this petition based on its merits, rather than on its adherence to some trendy legal protocol.

Reading this petition, the question for Europe is simple but vital: Does Europe want its aboriginal peoples to build Europe, or does it want to feed Europe to an alien interest?

Feedback and response: Notwithstanding the above plea for consideration, the editor agrees with readers who have voiced their objections regarding the quality of the English translation submitted to this site. As a temporary remedy, we have posted the (so far unapproved) translation provided by the Fehérlófő tankör (Study Group), and moved the originally submitted English translation to the end of the document.

The Honourable International Court of Justice:

I, the undersigned, Árpád Kásler (date of birth: 1 July 1972, place of birth: Déva, mother’s maiden name: Emilia Lukács, citizenship: Hungarian, personal identity number: 1720701 0231) representing the "Banki Adósok Érdekvédelmi Szervezete" (Bank Debtors' Protection League), (Petitioner), registered under No. 2817 by the Court of Justice of Békés County, Hungary, wish to register with the Honourable International Court of Justice in Hague the following complaint on behalf of the Petitioner.

I. In the course of the past twenty years, Hungary has been harried and colonialized by persons whocollectivelyrefer to themselves as the "Hungarian Government and Parliament," persons who have usurped the governance of Hungary. Therefore, I hereby lodge a complaint against these persons, jointly and severely, for their illegal use of force against the Hungarian people, carried out by, or under the direction of persons unlawfully acting ex-office. Furthermore, I denounce the aforementioned persons' deeds, conducted under the umbrella of organized crime, as high treason; illegitimate exercise of power; systematic theft, embezzlement and misappropriation of common wealth; as well as repeated offenses against the people of Hungary.

Reasoning:

1. Hungary lost her independence on 19 March 1944 when German troupes marched into Hungary. After the end of the Second World War, the country came under Soviet occupation which lasted until 30 June 1991.

The predecessor of the present “provisional” Constitution of Hungary was installed in 1949. In the spring of that year, the [Soviet-directed] "Magyar Függetlenségi Népfront" (Hungarian People's Front of Independence) coalescence set the proletariat-dictatorship, the creation of a worker-peasant power, and the building of socialism as its goal. During the elections of 1947, only candidates who attended upon the Soviet Union were permitted to run. The shift in power during the Soviet occupation of Hungary brought about a complete transformation of the political and governmental systems. This also gave birth to the 1949, Act XX (in the Constitution), modeled on Bukharin's 1936 [Bolshevik] constitution, a new rule of law enforced by Soviet forces "temporarily" stationed in Hungary.

2. After 40 years of dictatorship, the relieved dictator, János Kádár, signed a pact on 18 September 1989. During the months following, the designated Bolshevik Parliament worked feverishly to enact the results of negotiations between the newly formed "Nemzeti Kerekasztal" (National Round Table) - formed by new Parties without any significant memberships - and the Hungarian Socialist Workers’ Party into law. The Bolshevik Parliament ratified the majority of the agreements and elevated them to statutes, "as is." This process was crowned on 23 October, 1989 with Mátyás Szűrös proclaiming the Republic of Hungary from the balcony of the House of Parliament.

The secretary general of the Communist Party of the Soviet Union, Mikhail Gorbachev, proclaimed the "perestroika" resulting in the disintegration of the Soviet Union, the Warsaw Pact, and the Council of Mutual Economic Assistance. As a result, it became possible for liberated nation-states to restore order in their constitutional system. But this did not take place in Hungary(!) Hungary is the only country among the former socialist states where the constitution in effect is a constitution forced on the people during a military occupation. In 1989, Hungary broke ties with the former regime in a political sense only: She remained hobbled by that regime's constitution(!)

3. Hungarians reject the notion that a Constitution may be dictated at will by a regime that happens to be in power. The constitutional legitimacy of political power does not stem from the legality of some majority principle concept of the moment: it stems from its conformity to values enshrined in the culture of a people and to the permanent constitutional truths of human identity, and from the pursuit of such conformity.

4. The repatriation of The Holy Crown to Hungary in 1978 brought to light not only the possibility of, but also the responsibility for the reevaluation and worthy handling of Hungarian historical public law, jointly with Western European legal forms and values. A fundamental prerequisite is recognition of the Holy Crown of Hungary as a "legal person" whose status in law has remained continuous to this day. The Holy Crown personifies and represents complete supreme power and, as a state-personality, is especially well suited for the establishment and maintenance of social peace and equilibrium.

5. The representatives of the earlier communist regime, citing "their Constitution," excluded the Hungarian people from governance. The oligarchy that seized power after 1945 legitimized itself in 1989. This meant not only that criminal and other illegal acts committed by the communist regime suddenly become statute-barred, but also that running up state debts and nationalization - followed by spontaneous privatization of national wealth - became lawful and therefore legally incontestable. At the time of the change of political system, wiping the slate clean had been left out. Since the oligarchy wanted to retroactively legitimize its previous regime, it denied the citizenry the constitutional means to correct wrongdoings of the past and to bring about change in the interest of the nation's survival. Although the present administration decries the previous regime, in deed it continues to apply its ideology through continuity of law.

I request that these unlawful deforciants of Hungary be arraigned at the International Court of Justice in Hague.

II. I hereby lodge a complaint of high treason against the signatories of the Lisbon Treaty representing Hungary. The aforementioned signatories were not empowered with the legitimacy necessary to sign international treaties, an illegitimacy of which all sides were fully aware.

Reasoning:

1. In the spring of 2006, parliamentary elections were held in Hungary. Before the elections, the voters were denied the information necessary to make informed decisions. The government held back vital information in respect of the budget citing the effect such knowledge might have on the outcome of the elections. It released the dire figures only after its electoral victory. (The Criminal Code No. 211, section e., stipulates that influence by way of deception during an election is a criminal offense(!) Prime Minister Ferenc Gyurcsány and Finance Minister János Veres have announced - via a variety of media - that they will not make public the budget and the rate of unemployment before the elections. By withholding such relevant information during the election, the perpetrators have, de facto, committed influence by way of deception during an election, and therefore, committed electoral fraud and a criminal offense.)

The losing opposition party, FIDESZ, initiated proceedings to investigate electoral fraud to no avail.

2. On month after the election, Prime Minister Ferenc Gyurcsány addressed his cabinet in Balatonöszöd (Appendix No.1). In his speech, he boasted that, by way of a series of lies, he had led the population to believe that his government was in firm control, and that by way of trickery numbering in the hundreds, he had created the appearance of stability (of the country). It is self-evident that the left-liberal party in Hungary did not retain power in accordance with European norms of political process.

The Prime Minister's speech leaked out and was published on 17 September 2006, and created public disturbances in the capital. Riot police put down the protest with unchained brutality. Leaders of EU member states could have witnessed this horror had the foreign delegates not left early - fearing heightened security risks attributed to a series of ceremonies during the upcoming anniversary of the events of 1956, scheduled for October. (A year later, these leaders accepted as negotiating partners those criminals who retained power through fraud and violence. This raises the question of responsibility of the [European] Union's administration as well as that of the leaders of its member states.)

3. The representatives of the Hungarian Parliament approved - with near unanimity - the Lisbon Treaty without holding a referendum and before they could have read the official translation. The opposition FIDESZ party had the opportunity to vote against an accord signed by a Prime Minister and a Foreign Affairs Minister who were kept in power with lies. It even had the power to summon help from Brussels to enforce European norms in respect of Hungary. But it omitted these opportunities and, without even reading an accord that, in practical terms, terminates Hungary's existence, signed away the country's sovereignty. (It is to note that representative local government bodies in Hungary are bound by law to hold referenda on legal issues that may affect the autonomy of their jurisdictions.)

We ask the Honourable Court of Justice to declare the Lisbon Treaty invalid in so far the Republic of Hungary is concerned.

Over the last historical period, Hungary's confines have been squeezed to the point of her mere existence. She has become a truncated, looted nation forced to compete for her remaining resources against those who enjoy a lead at the start line. Foreign interests start out with an advantage assured by their fortunes of history, able-bodied competitors devoid of any sportsmanship who, rather than abstain from "para-Olympic games," grab the trophies intended for disadvantaged players.

Pursuant to the norms of International Law, the citizens of Hungary also have their say in the direction of their fate. The present illegitimate "Constitution" conceived by participants in the looting of the country does not provide for such rights.

The Hungarian Nation has exhausted all peaceful means to reverse the course of her destiny. But these attempts proved unsuccessful. We live in the heart of Europe, under occupation by foreign powers, dwindling at an alarming rate.

This is why we appeal to the Honourable Court of Justice to rule in favor of our right to self-determination and the right to life before we vanish into the sinkhole of history.

Appendix No. 1.

The complete written version of the speech told by Ferenc Gyurcsány in Balatonöszöd

It was passed in Öszöd on 26 May 2006

“Whatever I could tell you in the last one hour – nay it has been more than one hour – is of course not the whole of our politics, it is not able to include a host of things that must be done and it is not able to reflect the diversity of communication necessary for the success. Along with this, thank you very much for the warning and advices referring to this subject. If I am sincere with you I can say that we are full of doubts and that there is torment and anguish behind the self-assurance. I know exactly that all that we are doing will not be perfect. I have no clue what the sixth step is but I don’t even know the third one in a series of issues. I merely know the firs two. And we must try to take these issues forward simultaneously to maintain the cooperation and bona fide between us, to assure the support of the coalition partner, to prepare the managers and leading publicists of the most influential newspapers about what they can count on, to involve them in the process. To learn not to cry out in pain every moment and go on forward. It is not possible for me to predict the consequences of all our steps. It is impossible! We don’t have that much capacity. The truth is that the whole team works only from 7 a.m. to night and it cannot be expanded more after a certain point. It is impossible to sit round the table with more than 12-15 people where we have to come to an agreement with governmental people, ministerial people and experts. We cannot do it. This is the amount of talent we have, guys.

We did everything that could have been done during the past one month. We did whatever was possible to do in secret in the preceding months, making sure that official documents on what we were preparing for would not surface in the last weeks of the election campaign. We kept the secret while we knew and you knew as well that if the election victory comes, we will have to settle down to work seriously and that we have never had such a problem. Since last summer, we have been preserving our political unity and – behind it – let’s say, our professional political unity as never before in the recent years. Or even never. Obviously, everything we know i.e. the level of elaboration of our materials leaves much room for improvement. Yes, you are right. We know exactly that we are facing a lot of risks. When you are telling me that we should be aware because the constitutional Court might send stuff back, we know it. It isn’t a problem that you are telling it, however believe it, we know it. A very close team is working behind Jóska Petrétei because we cannot let it out in the whole of ministry in this phase. 5-6-7 people are working from morning to night in order to avoid any problems.

At certain points, we drive each other crazy to collect the necessary amount of money with our colleges but when the political reconciliations are going on, go to fucking hell with that. Let’s move on. There is no much choice. There is not because we have fucked it up. Not a little but a lot. No European Country has done something as bone-headed as we have. It can be explained, obviously we have lied throughout the past one and a half-two years. It was quite clear that it was not true what we were saying. We are beyond the country’s possibilities to such an extent that we could not conceive earlier that a joint government of the Hungarian socialist Party and the liberals would ever do. And in the meanwhile, otherwise we did not do anything for four years. Nothing. You cannot mention any significant government measures that we can be proud of, apart from the fact that in the end we managed to get governance out of the shit. Nothing. What are we going to say in case if we have to give an account to the country of what we have done in four years?

Naturally, the government’s work is not constructed nicely, calmly or scrupulously. No. No. It has been being prepared in a mortal hurry because we could not do it for a while in case it came to a light and now we have to do it so damned desperately that we are almost at the breaking point. And then we slowly end up falling over. Because we cannot do better in keeping up the pace. It is the situation. And in the meanwhile, we have to agree with the Free Democrats because of the ministerial problems and you know that. Look, the point is that there are no options in the shortest term. Jani Veres is right. It is possible to dither a little longer but not a much. The moment of truth has arrived quickly. Divine providence, the abundance of cash in the world economy and hundreds of tricks which you obviously don’t need to know about, have helped us to survive this. It cannot go on. Cannot. And of course, we can ponder for a long time and a fucking load of analyses can be done as to how any of the social groups will end up with this. I can tell you that we are unable to analyse the situation for weeks, guys. We cannot do it. On the first day we must tell what it is necessary to be done to ensure that an adjustment can be made this year. That certain tax regulations can be implemented on 1 September. I can go on analyzing for some weeks then others who are doing it as their profession say that they have already analyzed it. Hungary is written down.

So premising what we do is far from being perfect, I cannot tell you a “B” version. We have discussed, suffered, yelled this topic through with whoever influential opinion-shaper around the Hungarian Socialist Party in macroeconomy-related matters, from Kornai to Bokros, from Békesi to Surányi, from Vértes to heaven-knows-who. And I must tell you as well that I meet a lot of great ideas. Oh, gosh! And it turns out that even the greatest ones, the most respected ones make mistakes in the order of hundreds of billion. Let’s lay a residential property tax on everyone! Do you know how much income it gets in from a residential property tax in case if we tax every real estate that worth more that 5 million HUF? I stated a low value limit, not a hundred million, but five. And otherwise we give the 52 billion HUF that comes in from communal tax to the self governments as we have to give it to them – it is their income. The whole balance of the story is less than 20 billion HUF.

The most influential businessman of Hungary, Sándor Demján comes with an extremely loud voice, saying: “Feri, my dear fellow, I have just read in the Sárközi-report that in case if we close each background institution, we will save 700-800 billion HUF. I say: “Sanyi, my dear fellow, are you out of your mind?! At least you could know how to do calculations for god’s sake! There comes our fellow Gyuri Surányi and he says that he got the idea how the tax immunity of statutory minimum wage can be modified by preserving the social justice. And we keep working on it for a long time. Or he sends his document with the results of calculation and it turns out that everything is perfect with the exception that he does not know that the system of tax credit exists in Hungary today and it is necessary to change this system as well – it is 230 billion HUF as a whole. Oh yeah? We do not have a solution in case if this 200 billion HUF is involved in the calculations. In general, there are lots of good ideas as long as calculations do not have to be done. If calculations need to be done, then one runs out of wisdom. Generally there is a lot of criticism that the system is not complete enough it is not self-consistent enough, everybody has ideas what to take out from it then in order to let the remaining be more consistent and then we end up with roughly one third of the money that must be collected, instead. I can also be consistent such a way. My only problem is that it is not 50 billion HUF that must be collected, instead, I am not telling how much. Now it is the greatest problem. Moreover the whole thing must be done somehow on a way that it does not interfere with what we are willing to do in long term. Guys, we are not perfect. We are not perfect at all. We will not be either. I cannot say to you that everything will be OK. I can tell you what I have been saying in the past one year. We will do what can be carried out decently, what comes out from our talent, because we do not play special games, because we do not spend our energy on bullshitting with each other, because none has private interests, which otherwise would not stand publicity among us, because I am not willing to arrange anything with you.

The team that has been entrusted by the leadership of this side is roughly capable to accomplish this task. This team is roughly able to define a programme. Maybe there is another team that can do something else. We cannot, we cannot do anything more or better than this. We will not be capable of it. Even if we work ourselves into the ground. We are doing a huge and decent job among ourselves. We must do it. I am not going to speak about the New Hungary, the developments, the Hungarian people living beyond the border, the relationship with churches or another thousand things because they are not the most important things compared to the great, comprehensive picture. We will have substantial, significant and profound proposals on each. One or two of them will cause a surprise as well. But it is not the most important one compared to the whole which we have to decide among ourselves. Reform or failure – there is nothing else. And when I say “failure”, I am talking about Hungary, about the left side and I very honestly tell you I am talking about myself as well. And I want to speak only once for three minutes. I will only repeat it once at most.

It is a fantastic thing to do politics. Fantastic. It is a fantastic thing to rule a country. Personally I have been able to do it in the last one and a half year as one thing has given me the ambition and fuelled me: to give back the left its faith, that it can do it and it can wing. That the left does not have to lower its head in this fucking country. That it does not have to shit its pants from Viktor Orbán or the right and it should now learn to measure itself not against hem but against the world. It has given me the faith why it is worth doing this. It was a great thing, I loved it, it was the best part of my life. Now the faith comes from the fact that we make history. Not for the history books, I do not give a shit about them, I do not at all care whether we or I personally will be in them. I do not at all care. Will we do anything great? Are we going to say: “God-damn, some people have come for some days who dared to do it and did not fart around with how they would deal with the travel expenses, fuck it.” Some people came who did not fart around whether they would have a place in the self government because they understood that this fucking country is about something else. They can understand that the reason it is worth being a politician here at the beginning of the 21st century is to create a different world. Exclusively for it. Livelihood can be found in many different ways.

I know that it is easy for me to say. I know it well, please do not keep smacking it into my face all the time. But it is the only reason it is worth doing it. I almost perished because I had to pretend for one and a half year that we were governing. Instead, we lied in the morning, at noon and at night. I don’t want to do it any more. Either we do it and you have a person for it or someone else will do it. In case if we separate from each other in argument, I will never give a single interview at the end. Never. I will never hurt the Hungarian left. Never. But it is only worth doing it in order to touch the great, comprehensive issues. It is necessary to find another madam for explaining it and then sitting on long committee meetings and then holding a new work committee and then finding it out that never on a single law we can make an agreement because only those compromises are being resulted again that is the compromise of idleness, to preserve what there was before. Because everything else trespasses upon somebody’s interest. It won’t change my adoration, not at all. I won’t stand up every day. Gyula Horn had a minister of such a type who wanted to resign all the time. I had this kind of prime minister predecessor who was saying all the time that I am not that kind of guy. I will stay until there is force in it and we keep moving forward and then once I shall sneak away in a deep silence. It is not worth doing it for anything else.

Everybody should decide to oneself whether he/she is doing it for 400-500 thousand HUF which is fucking important, especially if one does not have any profession other than this, I know. Whether one will be able to move beyond the events of the last 15 years or one thinks that this will be similar four years again that yeah god-damn, we have survived the former one so far, we will get over this one as well. We had enough prime ministers, oh, we will get over this guy as well. We used to stay anyway. Maybe and I tell you that this is a legitimate argument and it does not even hurt my feelings, not at all. Not at all. There are more people in this fraction who are eligible to be a prime minister. I tell you to take a deep breath, drink a fucking large amount of wine, sleep on it for a couple of nights and make up your minds. If everybody can say only what has always been said in the past years and does not get to say „well, damn it maybe I have to say something else than I used to say for five years because we could not come to an agreement with each other”. Because if all the 190 socialist representatives say the same sentences that have been said in the past years, then similarly, nothing is going to happen because we similarly won’t be able to come to an agreement. Fuck it, although I don’t agree, I let it go. Let them do it.

Another time the other let it go, to let them do it. It is not a reform to expect the others to change. It is not a reform either that we stand out and keep telling the people the mantra. The reform is that we are willing to reassess everything we have thought and done before in many aspects. Compared to this, the matter of the first months, the matter of the adjustment is just a simple constraint. I must admit it to you. You are wrong at the point if you believe that you have a different choice. You don’t have. Neither do I. Today the choice is that we try to influence what is happening or it will damn fall on us. You are right, this solution is not perfect, surely not, but we don’t know a better way. Such that we can make an agreement on with the majority of the professional sector, that we can make the markets accept, that we can make the coalition partner accept and we sho do it on the top form Béla to Jani Veres, from Péter Kiss to Ildikó, from Imre Szekeres to Hiller believe that it is somehow good. Because we have to believe in them. Alone, separately we can do other things as well but we are not separate, instead some ten of us are sitting around the table and we have to accept is. I think that it can be done.

I think there will be conflicts, guys. Yes, there will be. There will be protests, there will be. It is allowed to protest in front of the Parliament, sooner or later the people will get bored of it and go home. It can only be carried out if you believe in the substance and there is an agreement in the substance. It must not start in case if we want to avoid the conflicts, if we are afraid of the fact that otherwise we trespass interests. It not ought to be started in this case. We don’t insist on anything, it is not true that I insist on something I have in my mind that it has to be the way in the healthcare system that it has to be the way in...er. I organize these discussions, I mediate them. I open up the fellows in order to let them tell what they have inside. I don’t dictate. It is not true. I only dictate in case if they want to slow down and they don’t want to come to an agreement. I say ’get moving god-damn’. I think it is my job. And when we came to an agreement, not to let them slow down. It is not about that I have the scenario on Hungary from A to Z and I am saying that I will beat that out from you. Bullshit! I have a scenario from A to Z on how that huge amount of energy hidden inside the socialists can be used in changing the country, make them put into it, make them finally overcome their defentism and their old verities. I have a scenario on this. And when it finally gets too much for me, I shout it out. I don’t have a personal story in this matter, not at all. I got a great snitch from what I have had the opportunity to do in the last one and a half year. My personal story is to let us change this fucking country because who else is going to do it? Is it going to be Viktor Orbán with his team?

Or option C: nothing is going to happen. It is feasible to flounder further for a while. It is obvious that the matter of healthcare system is very complicated. But anybody who goes into a healthcare institution knows that it is built on a set of lies. Of course, it is very difficult to touch anything in the educational system but yes, we can see that it does not distribute the knowledge equally. Somebody among you – maybe it was Gergely Arató – said that after all it is the greatest injustice that the Hungarian educational system on the one hand amplifies the social differences between us, it does not attenuate them, moreover it segregates as well. And it is the really serious problem. This is the big concern. And the big concern is that we offer the free-of-charge public education to those – you know – who come from the best families. According to this it is not the scandal that it has to be paid in 3 percent instalments. If there is a scandal in the society then it is that the top ten thousand people reproduce themselves by using public money. And we do not dare to tell it and we shit ourselves to say that for that matter one should pay the 7 percent. Do not indulge ourselves here. This is the real scandal. The real scandal is that Laci is talking about, his gipsy men, they get tenth the quality of the healthcare service I get. And since my mother’s name is known, she also gets better healthcare service fuck me. She did not know what had happened. “Has the healthcare system improved, my son? I reply: “Bullshit, mom! The truth is that they recognize your name”. This is scandalous. Compared to this, in a social sense the admission for medical attention in nothing. It is not a scandal, it is unpleasant politically and to pay it. Because politically it can have heavy consequences. But frankly, this consequence only affects us if we are idiots. Its social consequence that touches everybody. We do not dare to touch a bunch of evident social lies because we are afraid of the political consequences affecting us. But ladies and gentlemen! This is the problem of a couple of hundred people and their families and their acquaintanceship. But one shouldn’t be a politician just because one can make a fucking good living from this. Because we have already forgotten how it is to be a car polisher. Instead it is because we want to solve these.

And otherwise it is just the last four years’ experience, it is just the experience of Gyula Horn’s governance that people use to fail not for doing something or not for doing nothing. To hell, for what then actually? We need to start going. We need to know what we want to do. The first couple of years will be direful of course. It is totally irrelevant that only 20 percent of the population is going to vote or us. Last summer, first time in the last eight years merely 18 out of 100 people said that they are going to vote for us according to Szonda. Last summer, guys! One year after we won. What if we didn’t lose our popularity because we are fucking each other but because we deal with great social matters? And id does not matter if we temporarily lose the support, our support of the public. After all we will regain it. Because they will understand it. And one can go to the countryside calmly, by knowing that we did it, god-damn. Hasn’t it become better everyone? They are right. But for him, and him, and her and there were dormitories built in this maggoty country once again. This is what politics is about. It is not about who is going to become a regional mayor, how many deputies one will have. It is also important, I know, I am not naive. But it is not in the most important one hundred problems of the country. And we are the ones to decide which one to take care of, we. And I think the country deserves it and we deserve it too to do such things. So what I can say to you is to start, is to do it. You have a lot of truth in warnings, in the fear for us, in matters on details. I can only say that I will play no games, neither this way, nor that way. We are doing our job. Until it is possible to go the pace, we go the pace. If it is not possible to go, and you explain it, that “Yes, but...” for that I think you do not need me. You need someone else for that. And I will write fucking good books about the modern Hungarian left. Guys! Do I need to say anything else, Ildikó?

Honourable International Court of Justice,

I the undersigned Árpád Kásler (date of birth: 1 July 1972, place of birth: Déva, mother’s maiden name: Emilia Lukács, citizenship: Hungarian, personal identity number: 1720701 0231) as the representative of Labour Organization of Bank Debtors registered under No. 2817 by the Court of Justice of Békés County go to the Honourable International Court of Justice in Hague on behalf of the plaintiff with the following claim:

I. In the course of the past twenty years, Hungary has been harried and colonialized by the persons possessing themselves of the governance calling themselves „Hungarian Government and Parliament”. Therefore hereby I am lodging a complaint against them owing to their capital treason, exercising their power without any authorization, the institutionalized abstraction and expropriation of coffers as well as owing to the continuous committal of antipopular actions in confraternity of crime.

Reasons for judgement

1./ Hungary lost its independence on 19 March 1944 when the German army marched to the territory of Hungary. After the Second World Was had come to the end, the Soviet Army occupied our country and this Army stayed in Hungary up to 30 June 1991.

The predecessor of the present “provisional” Constitution of Hungary was introduced in 1949. In spring of 1947, the dictatorship of the proletariat as well as the creation of the empire of working class with the peasantry in addition the building of socialism were indicated by the Hungarian Independent People’s Front as their purposes. Merely the Hungarian candidates lackeying the Soviet Union were allowed to take part in the elections in 1947. As a consequence of the changes taken place in the power during the Soviet occupation, the political system and government underwent an entire transformation in 1949. This situation manifested itself in the Law No. XX of 1949 (in the Constitution) as well that was compiled by taken the Buharin Constitution as a basis by the background-support of the Soviet Army being stationed at Hungary “temporarily”.

2./ After a dictatorship lasting for 40 years, the results of negotiations carried on between the National Round Table established by the new Parties being almost void of members and the Hungarian Socialist Workers’ Party were ratified by the Parliament of the Bolshevik nomenclature in the month following the agreement signed on 18 September 1989 in Hungary led by János Kádár. The majority of agreements were approved in an unchanged form. To pinnacle this process, the Hungarian Republic was proclaimed on 23 October 1989 from the balcony of the Houses of Parliament by Mátyás Szűrös.

The secretary general of the Communist Party of Soviet Union Mihail Gorbacsov proclaimed the “perestroika” resulting in the disintegration of the Soviet Union, the Warsaw Treaty as well as of the Council of Mutual Economic Assistance. As a result, it became possible for the independent nation-states to reconstitute their constitutional system but it didn’t happen in Hungary! Hungary is the only country among the ex-socialist countries where a Constitution exists that was compiled during a military occupation. In 1989, the earlier system was changed only in political sense but not in constitutional sense.

3./ Pursuant to the Hungarian conception, the Constitution is not dictated at will by the actual political power. The constitutional legitimacy of power does not rely upon a legality having a majority principle but it aims at meeting the eternal cultural, constitutional human truth and constitutional values.

4./ The Holy Crown was delivered to Hungary in 1978 and this action has brought up the possibility and responsibility of the re-evaluation and handling of the Hungarian historical public rights in accordance with the legal forms and values valid in Western Europe. It is an elementary pretension that the Holy Crown of Hungary shall recognize as an eternal subject of law as a special personality of the state representing the completeness of chief power and suitable for creating and maintaining the social peace and equilibrium.

5./ Pursuant to the “Constitution”, the earlier representatives of the communist power excluded the people of Hungary from the system of government. The oligarchy obtaining the power after 1945, legalized itself even in 1989. It means that the criminal acts and other non-legal actions committed by the communist power became forfeited so the indebtedness of the state or the nationalisation and later the spontaneous privatization became legal and undisputable in legal sense. The change of political system did not start with a constitutionally “clean sheet”. As they wanted to make the past system legal afterwards, they did not give the constitutional possibility to the community for improving or changing some matters in order of the persistence. Though the present system disapproves the old system verbally, it undertakes a legal continuity with it by its actions.

It is requested that the deforciants of rights and power without authorization are arraigned at the International Court of Justice in Hague.

II. Hereby I am lodging a complaint against the representatives signing the Lisbon Treaty from the part of Hungary; the aforementioned representatives didn’t have the

legitimacy necessary for signing any international treaties therefore they are treasonists.

Reasons for judgement

1./ In spring of 2006, there were elections in Hungary. Before the elections, the freemen were not informed about the real situation therefore they were unable to decide in accordance with the reality; the government kept back the state of budget by referring to the fact that the results of election could be influenced by publishing the real data. The inhabitants were informed about the painful data only after the election resulting in victory for the government. (The manipulation by misrepresentation during the elections is determined as a criminal act by point e) of section No. 211 of Criminal Code. Prime Minister Ferenc Gyurcsány as well as the Chancellor of the Exchequer János Veres often announced in the media before the elections that they would not inform the inhabitants about the state of budget as well as about the situation of unemployment therefore they committed the criminal act of gerrymander and the criminal act of manipulating the elections by misrepresentation.)

The FIDESZ – i.e. the Party in Opposition which lost the election - initiated an action owing to the gerrymander but it didn’t conduce to a result.

2./ On 17 September 2006, the speech having told by the prime minister Ferenc Gyurcsány in Balatonöszöd one month after the elections was published in the press (Appendix No. 1). In his speech, Ferenc Gyurcsány told that he had told lies, he had tried to suggest that the ministry led by him administered and by using a lot of different tricks, had tried to suggest that the country was stabile. The left-liberal political party kept the power in Hungary such a way that they used means that do not conform to the European norms. The publication of the speech resulted in disorders in the capital. The remonstrances were smashed by the police by a brutal aggression – this aggression could be seen by the leaders of EU member-states as well because – owing to the high risk - the foreign delegations left untimely the gala organized in October 2006 for celebrating the anniversary of 1956. (In spite of this fact, the leaders of these member-states accepted the aforementioned Hungarian leaders obtaining the power by tricks and aggression as negotiating partners; this fact poses the question of responsibility of the administration affairs of EU as well as the responsibility of the leaders of the other member-states).

3./ The Lisbon Treaty was practically accepted and approved by the representatives of Hungarian Parliament by common consent – without referendum - before reading the authentic translation. The FIDESZ raising an objection to the gerrymander unsuccessfully now would have had the opportunity for voting by “not” to the Treaty signed by the prime minister and the foreign minister keeping their power by lying and for enforcing the respecting of the European norms in Hungary but they missed this opportunity; they signed the Treaty eliminating practically the sovereign Hungary without reading it. (Hereby I would like to note that in our country, the body of representatives of self governments are obliged to announce a referendum for the questions concerning the autonomy of their settlement).

The Honourable Court of Justice is kindly requested to state that the Lisbon Treaty is invalid from the point of view of the Republic of Hungary.

In the last historical period, Hungary attained to the confine of its existence. Nowadays our country has become a truncated, unpeeled nation and has nothing for it but to compete for the remaining possessions with such countries that could start from a more favourable situation historically and that don’t have any sportsmanship i.e. they try to take all the trophies from the Para-Olympic Games as healthy nations.

Pursuant to the norms of the international law, the citizens of Hungary have the right to intromit in the direction of their own destiny but the present illegitimate “Constitution” created by the persons taking part in the sacking of our country does not give any possibility for it.

The Hungarian Nation has already attempted to use all the peaceful means in order to improve its destiny. These attempts were of no avail. We live in the middle of Europe as an unpeeled nation occupied by foreign empires in addition the population of the Hungarian Nation decreases apace.

Referring to the aforementioned facts, the Honourable Court of Justice is kindly requested to express the autonomy of our nation in order that we can use this right before disappearing in the sink of history.
